For those of you who hold a Residence visa / KITAS in Indonesia which is valid for one year, you can apply for a Permanent Stay Permit / KITAP which is valid for 5 years if you meet the requirements and meet the criteria as a candidate for a KITAP holder. If you meet the requirements, then the KITAP can be issued by Indonesian immigration, so you don’t have to extend your residence visa/KITAS every year. Permanent Stay Visa / KITAP can be extended every 5 years or at the time of the next extension you can also apply for a lifetime stay visa / KITAP, so you don’t have to renew every 5 years. The process of obtaining a KITAP can only be done by way of conversion, which is only for foreigners who already have a KITAS and the KITAS status is still valid at the time the KITAP is submitted.

To whom KITAP can be given ?

KITAP can be given to :

  1. Foreigners who hold KITAS as clergy, workers, investors, seniors
  2. Family due to mixed marriage (between Indonesian citizens & foreigners)
  3. Husband, wife and/or children of foreigners holding KITAP
  4. Foreigners who are ex- Indonesian citizens and ex-children with dual citizenship of the Republic of Indonesia.

What is the advantage of owning KITAP ?

If you already have a KITAP, you will get several conveniences in the following ways :

  1. Get an ID card and family card that is valid for 5 years
  2. You can get a driver’s license / SIM valid for 5 years
  3. You can open an account at a local bank
  4. You can apply for a credit card
  5. You can get an exit permit/ MERP for two years
  6. You can own property together with your partner who is an Indonesian citizen.
  7. Register a mobile phone

How long the process to get KITAP ?

The processing time to get a KITAP is about 2 – 3 months, depending on the completeness of the documents as requirements that must be attached and also depending on the domicile area where the applicant lives.

Are KITAP holders allowed to work ?

KITAP holders are allowed to work in a company or carry out work activities in a workplace such as an office building, factory or school for those who work as teachers, after they have a work permit/ IMTA from the Ministry of Manpower.

To get a work permit / IMTA the company that employs foreign workers is required to pay a DPKK / levy to the Ministry of Manpower in the amount of USD 100 per month of work or USD 1200 for a period of 12 months which is paid in full upfront and cannot be paid in installments .

Is KITAP become void due to divorce ?

True, the occurrence of a divorce with an Indonesian partner can cause your KITAP to be canceled. Unless the age of marriage is 10 years or more. In the event that the age of marriage is 10 years old, your next KITAP sponsor will be your new wife.

Can foreigners holding a permanent stay permit / KITAP establish a local PT company?

For foreigners holding a Permanent Stay Permit/KITAP can establish a local PT company and serve as a director but cannot own shares, thus he/she cannot obtain an Investor Visa/KITAS.

Can a holder of Permanent Stay Permit /KITAP valid for 5 years get an unlimited KITAP?

Answer:

Yes, he/she can, a holder of regular Permanent Stay Permit/KITAP can get an unlimited KITAP after spending the first 5 years of his/her KITAP validity.

Does a holder of unlimited KITAP no longer need to renew his/her KITAP every 5 years?

Answer:

Yes, there is no need to renew, he/she only needs to report to the immigration office every 5 years for data renewal at the immigration office.

Can a holder of KITAP get Citizenship/WNI?

Answer:

Not all of them can. Those who can get an Indonesian citizen is only the holder of Temporary Stay Permit / KITAS who is married to an Indonesian citizen and or the holder of Permanent Stay Permit/KITAP with a position as director and shareholder in foreign companies in Indonesia, after living in Indonesia for 5 consecutive years using a Temporary Stay Permit/KITAS

If we change our home address, do we have to notify the immigration office?

Answer:

Yes, you are required to report to the immigration office where your Stay Permit Card/KITAS/KITAP is issued.

What things can make a Permanent Stay Permit Card/KITAP invalid/forfeited?

Answer:

A Permanent Stay Permit/ KITAP can be canceled for the following reasons:

  1. Discontinuation of marriage relationship of a foreigner who is legally married to an Indonesian citizen due to divorce and/or a court judgment, except for 10 years or more marriages.
  2. Leaving the territory of Indonesia for more than 1 (one) year or not intending to re-enter the territory of Indonesia.
  3. Subject to deportation or death
  4. Conducting activities that endanger state security.
  5. Providing incorrect information in submitting an application for a Permanent Stay Permit/KITAP
  6. Not extending the Permanent Stay Permit/ KITAP after 5 (five) years.

Procedures

After we have received the documents completely, then we shall begin to submit  the application to the Local Immigration Office nearest to the applicant’s residence. After getting a recommendation letter from The Lokal immigration office, the next process is to get approval from the regional office of the Ministry of Law and Human Rights at the provincial level and the next process is to get final approval from the Directorate General of Immigration in Jakarta. The total processing time takes about 6-8  (thirty-five) working days to obtain the KITAP approval from the Immigration Authorities in Jakarta. As soon as the KITAP application is submitted, the Immigration officers will carry out a field check. Immigration officers will come to the applicant residence and take pictures of the applicant at the location of residence to carry out data verification, and for the field check process or visiting the applicant’s residence it will take about 2 weeks. After the KITAP approval has been granted the Directorate General of Immiggration in Jakarta then the applicant are obligated to come to the immigration office to perform biometrick session. In 7 (Seven) working days after KITAP has been signed, then you may receive KITAP card.

Note:

The things to be noted at the time of coming to the immigration office in order to sign KITAS and photo taking:
1. For male, it is not allowed to wear sandal and shorts.
2. For female, it is not allowed to wear sandal and mini/scanty dress.

What are the requirements for applying KITAP ?

To apply for a visa you must attach the following documents  :

  1. Original passport
  2. Passport is still valid for not less than 30 months at the time of application for KITAP
  3. A valid KITAS, and those who have lived with a KITAS for 13 months are also allowed to apply for a KITAP.
  4. Last SKTT
  5. Certificate from the Lurah stating that the KITAP applicant does reside at that address and is still married to his wife/husband.
  6. Copy of marriage permit from the Embassy of a foreign country in Indonesia (for foreigners who have carried out their marriage in Indonesia). This letter is very important for immigration authorities and if it is not there because it is lost, it will be an obstacle for submitting a KITAP. Or the immigration office may be able to provide a solution by requiring the applicant to pay extra to the immigration office for the lack of these requirements.
  7. House rental agreement letter
  8. Marriage Certificate
  9. ID card & family card (owned by Indonesian spouse)
  10. A survey of the location of residence will be carried out by the immigration office, the immigration office will take a photo of the husband and wife directly at the residence of the KITAP applicant, for data verification to make a report on the Examination Procedure / BAP
  11. The age of marriage has reached 2 years at the time of submitting the KITAP.
